  • Factfile on ASBOs

    Asbos originated from the platform of the Crime and Disorder Act 1998. An Asbo is a civil case heard by magistrates. It is designed as a way of tackling persistent anti-social behaviour and used to protect people whose lives are disrupted by the actions of specific individuals. It can be used to keep individuals away from specific towns or areas, at certain times, or can be used to prevent someone from doing something as simple as feeding pigeons or as serious as using violence against a partner. Breach of an Asbo can result in up to five years in jail. Almost half of all Asbos have been served on juveniles. An order can be applied for against any individual who is over the age of 10. More than 160 have been issued to children aged between 10 and 12. By the end of June last year a total of 6,497 Asbos had been reported to the Home Office and 938 of those were in Greater Manchester alone and 237 in Lancashire. You cannot apply for an Asbo as a private individual but it must be sought by the police in an official capacity, together with the local authority in question it is a joint undertaking. The minimum length of an Asbo is two years. Before an Asbo can be applied for there must be evidence of some form of antisocial behaviour, which can include foul and abusive language, threatening behaviour, assault, shouting, criminal damage, theft, disorderly conduct, vandalism, intimidation and bullying, racial harassment, homophobic behaviour, behaviour as a result of drug or drink misuse, excessive noise, graffiti and littering. Asbos are expensive some reports say as much as £20,000. If a person breaks an Asbo they can be arrested and brought before the court again. Breaching an Asbo is a criminal offence and penalties can range from six months to five years in prison. The youth court for youngsters aged 15 to 18 can only impose a maximum custodial sentence of six months. read more
