WITH reference to the story "Nightclub owner fined over asbestos risk."
This incident occurred when the nightclub was closed to the public due to redevelopment. An asbestos survey had been undertaken at the nightclub two years prior to the redevelopment. However, following an unannounced inspection by the Health and Safety Executive, the owners of the nightclub arranged for a further asbestos survey to be undertaken.
This revealed a small amount of asbestos in an area of the basement that was not undergoing any redevelopment, was not readily accessible and was unlikely to have been disturbed by anyone.
The court concluded that the likelihood of anyone being affected by the material was low. Any issues raised by the HSE were addressed immediately, the offending material was removed and there are no on-going concerns in relation to asbestos or any other health and safety issues.
