REBEL landlord Nick Hogan faces a battle to stay in charge of the Swan and Barristers, according to a rival.
Owner of the Flying Flute in Bradshawgate, Darren Miller, claims he has bought the two pubs, meaning Mr Hogan - who has defied the national ban on smoking in public places - will be kicked out.
Mr Miller has vowed to stop regulars from smoking in the two venues, in Bradshawgate, when he takes ownership on September 21.
But Mr Hogan, who leases the pub from its owner Paul Kylie, claims he will not relinquish his lease or licensee rights unless he receives the right offer, even when Mr Miller becomes the new owner.
And he is intent on continuing his battle with Bolton Council over his insistence on allowing drinkers to light up indoors.
Mr Hogan is due to appear before Bolton Magistrates on September 14 to answer five charges of allowing people to smoke in his pubs and four of obstructing council officers.
Mr Miller said he had bought the pubs with a vacant possession, allowing him full control of the bars.
He said: "I have exchanged contracts and no matter what Nick Hogan says, he won't be there then. There are two courses of action open to him and if he takes the wrong one, he could end up with nothing.
"The Swan is the only pub in Bolton town centre that has a really nice outdoor smoking area, and we intend on improving on that.
"We certainly won't be allowing smoking but if Nick wants to buy the ashtrays he's more than welcome to them."
Mr Hogan claims he has not given up his lease, even though he has received an offer for it to be bought from him.
He said: "I haven't agreed to sell any part of my interest in The Swan. I own the lease and am the licensee of both The Swan and Barristers and I'm not going to relinquish any of them.
"I've been made an offer, which I've refused and I won't relinquish my interests in the business unless an offer is made to me which is acceptable."

Nazism has come to stand for a belief in the superiority of an Aryan race, an abstraction of the Germanic peoples. During the time of Hitler, the Nazis advocated a strong, centralized government under the Führer and claimed to defend Germany and the German people (including those of German ethnicity abroad) against communism and so-called Jewish subversion. Ultimately, the Nazis sought to create a largely homogeneous and autarchic ethnic state, absorbing the ideas of Pan-Germanism.
Historians often disagree on the principal interests of the Nazi Party and whether Nazism can be considered a coherent ideology. The original National Socialists claimed that there would be no program that would bind them, and that they wanted to reject any established world view. Still, as Hitler played a major role in the development of the Nazi Party from its early stages and rose to become the movement's indisputable iconographic figurehead, much of what is thought to be "Nazism" is in line with Hitler's own political beliefs - the ideology and the man continue to remain largely interchangeable in the public eye. Some dispute whether Hitler's views relate directly to those surrounding the movement; the problem is furthered by the inability of various self-proclaimed Nazis and Nazi groups to decide on a universal ideology. But if Nazism is the world view promulgated in Mein Kampf, that world view is consistent and coherent, being characterized essentially by a conception of history as a "race struggle"; the Führerprinzip; anti-Semitism; the stigmatization of "Judeo-bolshevism" and the need to acquire a Lebensraum at the expenses of the Soviet Union . The core concept of Nazism is that the German Volk is under attack, and must become united, disciplined and self sacrificing (must submit to Nazi leadership) in order to win against this nefarious "Jewish plot" to subjugate the German nation.

Also where are the enforcement officers; probably at home wishing they'd never taken such a bloody awful job!
The true reason they haven't handed out fines; is so they can make the complience figures look good. Talk about "Cooking the Books!"
Fact..Over 57% of population only wanted a Partial Ban!
Like Max says...Nick, at least has the Balls to stand up for His beliefs/Rights1

Nick Hogan, and all those at Freedom2choose are heroes who should be lauded. Only mindless idiots could possibly think any other way. Nick appears in court on the 14th of this month, so that gives us an opportunity on the weekend of the 15th/16th to show defiance and contempt for this stupid law. I suggest a mass defiance rally at the Swan that weekend.
