Battle over right to run rebel smoking pub

REBEL landlord Nick Hogan faces a battle to stay in charge of the Swan and Barristers, according to a rival.

Owner of the Flying Flute in Bradshawgate, Darren Miller, claims he has bought the two pubs, meaning Mr Hogan - who has defied the national ban on smoking in public places - will be kicked out.

Mr Miller has vowed to stop regulars from smoking in the two venues, in Bradshawgate, when he takes ownership on September 21.

But Mr Hogan, who leases the pub from its owner Paul Kylie, claims he will not relinquish his lease or licensee rights unless he receives the right offer, even when Mr Miller becomes the new owner.

And he is intent on continuing his battle with Bolton Council over his insistence on allowing drinkers to light up indoors.

Mr Hogan is due to appear before Bolton Magistrates on September 14 to answer five charges of allowing people to smoke in his pubs and four of obstructing council officers.

Mr Miller said he had bought the pubs with a vacant possession, allowing him full control of the bars.

He said: "I have exchanged contracts and no matter what Nick Hogan says, he won't be there then. There are two courses of action open to him and if he takes the wrong one, he could end up with nothing.

"The Swan is the only pub in Bolton town centre that has a really nice outdoor smoking area, and we intend on improving on that.

"We certainly won't be allowing smoking but if Nick wants to buy the ashtrays he's more than welcome to them."

Mr Hogan claims he has not given up his lease, even though he has received an offer for it to be bought from him.

He said: "I haven't agreed to sell any part of my interest in The Swan. I own the lease and am the licensee of both The Swan and Barristers and I'm not going to relinquish any of them.

"I've been made an offer, which I've refused and I won't relinquish my interests in the business unless an offer is made to me which is acceptable."

Nick Hogan was on a hiding to nothing when he began his crusade against the anti-smoking Nazis. At least Nick and the guy from Blackpool have had the guts to stand up against this grossly unfair law. I am an ex-smoker who is totally opposed to this ridiculous law.

Mr Miller why waste your money on an outdoor area when that could be outlawed within 3 years. Typical shortermism it seems when with the money one spends on constructing these outdoor areas one could be challanging this redicolous and divisive law and restore property rights. I called in my local last night at about 8.00. There were 2 people sitting inside and about 20 sitting outside in the smoking area. Obviouly they won't be sitting there in January. This doesn't seem fair to me.

i agree nick had the gutts to challenge this stupid law

i know one landlord who has lost a lot money since the ban , his bar is only half full now
the goverment should compensate for this as it was their law that caused it

Good Luck Nick, hope your pub is still as full as ever, it is great, at least it still has some atmosphere and soul. Which is more than can be said for many others. I did see a little elderly gentleman reading his paper in a pub a few doors down from the swan, no-one else in there though.

I can confirm that this afternoon, Nick Hogan was successful in obtaining a court injunction against Darren Miller and Paul Kyle as a result of obvious bullying tactics. Both are barred from entering either of the venues currently leased by Nick Hogan.

and I hope that officers are ther to give on the spot fines as it is breaking the law. Hogan is going tolose his licence as he is defying the law of the country. A law-breaker cannot be a licensee!!!

If the law was to be overturned don't you think it would have well and truly happened before it actually came law with the help of the Scots, Welsh and Northern Irish who have had the ban longer than us.

The fact being, to smoke is no longer in fashion with the majority of people. Ipso Facto laws have been created with the support of the majority. This is not just happening in the Uk and US but it is also happening in Australia and on the mainland of Europe.

If smoking ever becomes fashionable again then the laws could change but up until then the laws as it stands will stay.

If Nick Hogan has a lease, which I'll assume was checked over by his solicitors. Millers claims are inexcusable and display what the man really is..a bullying thug who throws his toys out of his pram as he struggles to pay his loans off.

Assuming once again, the club above the Flying Flute is his. I would suggest the Police visit with sniffer dogs. You never know what they may just turn up.

i want to tell everybody a true story about a man called Jack who is 89 years old jack used to come to the pub sit in a corner with his beer and fag everybody used to love to hear about him fighting in WW2and how things were when he was younger Jack lost his wife 15 year ago so he used to come for company and there would be someone who sit and talk to him but now Jack does not come to the pub anymore he just sits at home and have a few cans in the house the reason why he does not want to come into the pub is because he does not want to be a burden to anybody which means that someone would have to take a chair out side onto the pavement for Jack and stand with him until he has had his fag but also he saysthat iam not going to stand outside in winter when that north wind blows from the north sea ans bitter cold what has got Jack mad is that him and his father fought for freedom in this country he is proud for what he did but he thought in his life time that he would see another hitler who was telling the Germans how there life should be ran during the 1930,s Jack never thought that in his own country would this ever happen he said to me the other day who voted ASH into government i asked why his reply was that ASH thinks they are politicians and they should be in power Jack as never known of a government who as listened to any so called groups like ASH this government as not got a mind of there own this government wants the perfect country everybody got to be a size zero don't drink don't smoke just to work and sit at home misableand tax us up to the hilt and if anybody thinks that things are going to get better then they are fools Jack says he would like to old fashioned pubs to come back where they was a smoke room and a lounge for the non smokers which did work Jack is always saying the old ways were the best and i agree with some of the things

Emma, maybe you could tell Jack, that although he fought in WW2, for our Country it seems Amosc99 does not want him voicing his opinons in Bolton, great even I thought freedom of speech was still allowed all over the UK.
There are a lot of elderly people like Jack, who sadly will lose out on a social life now.

It was a story and not related to Bolton. If you want to tell stories, do it in your part of the country. People up here have their own stories (whether true or fiction) to tell. But would you like it someone from Bolton trying to tell a story with a subversive message in your local paper. We, in Bolton, like you, are proud of our town and what we can contribute to the town, but have no interest on inflicting our contributions to your town(s) as each town has its own unique identity and social scene.

Freedom of speech I do believe in but to try to give subversive messages through storytelling is NOT freedom of speech - its a form of indoctrination - something which our older generation fought against!

The law as it stands at this moment is that no-one is allowed to smoke in public buildings - but there are always solutions to every problem!!!

I come from just down the road from Withernsea and was delighted to read about Jack, (though it was not a happy story). Anybody who thinks posters should keep to their own area shouldn't be using the internet, or what else can they expect. You only complain when an outsider's point of view contradicts your own.

I have been having fun looking up the smoke cessation scam, its now up to £85 for a pharmacist to get a smoker to give up for 4 weeks.
