Smoke rebel landlord locked out

REBEL landlord Nick Hogan has been locked out of his pub.

And by last night he had also lost the licence for the The Swan hotel in Bolton town centre and the neighbouring Barristers bar.

Mr Hogan has been in the headlines for his stance on the smoking ban, introduced in July.

He has repeatedly allowed drinkers to smoke in his bars and is now awaiting trial after pleading not guilty to five counts of failing to prevent people from smoking and four counts of obstructing council officers.

The owner of The Swan and Barristers building, Paul Kylie, called in a team of bailiffs to force entry to the building and change the locks yesterday morning.

He claimed Mr Hogan had breached the terms of his lease - which states he must abide by all UK laws - by allowing customers to smoke.

A notice placed in the window said any attempts by Mr Hogan to re-enter the premises would lead to criminal or civil action being taken against him.

In a day of dramatic twists and turns, Mr Hogan then took court action and won the right to re-enter the property.

But within hours, Bolton Council's licensing department agreed to an application by Paul Kylie to change the tenancy to his son Ryan.

Last night Mr Hogan, who has run The Swan for the last three years, claimed he had been the victim of a stitch-up.

Mr Hogan said bailiffs forced entry to the Swan and Barristers at around 6.15am and activated the burglar alarms.

He immediately drove to the pub and met his manager, and said he found Paul Kylie and a number of bailiffs in the yard.

They had changed the locks and chained the gates which lead to the entrance of the Barristers bar.

Mr Hogan contacted his solicitor and took the matter to a hearing at the High Court in Manchester, where he won the right to get back into the property.

He claimed he couldn't be branded a law breaker until he had been convicted in relation to breaching the smoking ban.

But meanwhile, Mr Kylie and his son had visited Bolton Council's licensing department, where they got the tenancy of The Swan and Barristers changed so Ryan Kylie was the new licensee.

Licensing Act laws say that it is within the rights of a pub owner to change the nominated licensee if he or she is able to prove they can run the premises for the reason they were licensed.

The owner must also have tried to gain the consent of the current licensee to the change.

Mr Hogan said last night: "Bolton Council has acted illegally, they have acted irresponsibly and I believe they have taken this course of action because I have allowed people to smoke, despite the smoking ban.

"The council must be off their rockers to do this. I will sue them over this - then I'll sue them again."

A spokesman for the council's licensing department said hearings regarding a change of licensee were "nothing out of the ordinary".

"They can normally be completed in a fairly short period of time. On this occasion we were satisfied that parties involved were able to satisfy all the criteria necessary," he said.

"If Mr Hogan wishes to invoke a similar process, it is well within his rights."

The Swan and Barristers are at the centre of a tug-of-war, with owner Paul Kylie reportedly offering them for sale with vacant possession to Darren Miller, the owner of the Flying Flute in Bradshawgate, Before yesterday's developments, Mr Hogan claimed the sale could not happen because he has a lease on the pubs until 2040.

Mr Kylie was not available for comment yesterday.

But last night The Swan and Barristers were open for business as usual.

The owner has thrown him out for breaking the law and violating his lease,what's that got to do with police cautions for assault?
I wouldn't know about the DJ looking like Shrek,I prefer smoke free pubs.

No! the owner and his thugs have illegally gained access with the aide and abettence of Bolton Council. They did not approach Mr Hogan to discuss it, which is required by law before the licencee can be changed. Once again, the thugs of Bolton Council have acted, probably got a backhander of kylie. Oh when will the people of Bolton wake up and git rid of the gestapo posing as councillors?

Keep fighting Nick, I hope that all of the smokers now boycott the Pub, from an Ex-smoker that believes in human rights. There are plenty of Pubs for the real anti-smokers like Erica, who by his/her own admission wouldn't go in the Swan anyway.

Unfortunately when you break the law as was allowed in this case the Licensee can have his licence revoked and at that precise moment his lease becomes invalid so therefore they didn't break the law.

I've been and asked a local landlord about this.

I think Hogans defence of innocence as he has not been proven guilty yet is flimsy to say the least, he has missed no opportunity to speak to the press and openly admit that he knows he is breaking the law and doesn't give a t***. He has stated on mumerous occasions that he will break the law until he has his day in court. So anyone would say that the owner's stance that he has broken the terms of his tenancy is a resonable argument.

Indeed, where are freedom2choose? What are they organising in support of Nick Hogan? Will the pub be picketed by smokers? Will leaflets be handed out in the street urging people to boycott the pub?
I doubt it, because at the end of the day it's nothing more than a minor inconvenience to smokers and healthier for the rest of us. In the 15 months leading up to the ban there were no marches in the streets. There was no organised revolt. Just a bunch of hardliners posting on here telling us how they should be allowed to smoke in pubs because "passive smoking is harmless".
They were toothless. Absolutely toothless.

Tell us which of the political parties has offered to scrap this rule.
And if there are none, then perhaps the smokers of Bolton would like to start their own party and stand in the next local elections. Let's see how much support you really have.

Whilst I concede that people should have a right to choose, cigarette smoke and its ill effects do not confine themselves to smokers. Case in point Roy Castle.

Nick hogan has not broken the law until a court decides he has. This eviction and tenancy change business is a deliberate act of hate campaigning in an attempt to oust him before his trial. It is obvious to all concerned that if Mr Hogans case is aired in court, the council will be shown for the disgrace it is. And so they will support any measures to remove him beforehand.

It used to be a principle of British justice that one person prosecutes you, and another decides the verdict, applying legal principles. The prosecuting authority can't decide you are guilty. That is an abuse of process, and Bolton council should be ashamed of themselves.

Why should the Council be ashamed of themselves? This action has obviously been instigated by the owner of the premises who believes an illegal activity is taking place there. Admittedly, the owner is trying to sell the building, something that would be harder to do if the lessee or tenant has had his licence revoked, and is trying to cover his own back.
As to whether Mr Hogan is guilty or not, I'm sure that if you read the comments left on some of the earlier threads on this case you would be left in no doubt that what has been happening in the Swan is illegal. The only surprise in this case was if Mr Hogan was found not guilty.

Noble concepts such as freedom and choice have been trampled under the mad rush to persecute the smoker. Prior to this ban we all co-existed, smoker and non smoker, but now the antis have revealed their long simmering plan, persecution on a national level. To stand against such unrelenting hate takes courage and Nick Hogan is an example to us all. If he dares to face up to to such repression, only the persecutors can condemn him, and show themselves for what they are, anti freedom, anti social bigots. Smoking is not the issue here, freedom of choice for all is.

Since when did you become a Judge?

He has been charged, and pleaded not guilty, and is awaiting his court case. As the regulations clearly state, transferrance of his licence is not allowed unless he is consulted first. That didn't happen, so that is illegal. Simple really.

The authorities are not consulting him as they consider him to have broken the law already. But he hasn't as it hasn't been tested in court yet. He is still not guilty until proven so. Therefore the denial of his licence is not only illegal but also perfect grounds for litigation by Nick Hogan whether he is subsequentially convicted or not.

I'm glad you're happy about Bolton officials throwing Council taxpayers' money down the drain so easily.

Plus, it shows that you are obviously quite happy with the legal system being treated with contempt.

Those last two comments rather prove my point Hatemanu. Either you clearly failed to grasp the concept of my previous comment or you accepted my final closing offer to show yourself for the bigoted fool you are. Perhaps a few hours in school would aid your faltering argument, but I doubt it.
And as I said this is not a matter of smoker against non smoker, but rather a struggle between freedom and those that deny it, the anti smokers.

It wasn't Nicks pub, get your facts right. He's been thrown out as he couldn't obey the law. We don't live in a dictatorship, you don't have to STOP smoking, just do it somewhere to minimise the effects on people who choose not to increase their chances of cancer and heart disease i.e. outside. As for the person who says anti-smokers should choose elsewhere to drink then you are making your your own rules up. Paul Kylie has every right to chuck Hogan out his pub, he is breaking the law day-in, day-out for us all to see. Without out laws like this being enforced we won't reduce the number of cases of people dying of disease uneccessarily. Someone needed to stand up to him

I say to that rediculous proposistion, We are all free to choose the manner and name of our respective gods, each individual may believe as his or her concience dictates, but none have the right to impose their religion on another.
We do not impose our smoke on others as they are free to choose not to enter premisses in which we smoke, just like you are free not to enter a place of worship not to your liking.
On the other hand you feel that you have a right to enter anothers property and dictate your intolerance of their activities upon them.
And incidentaly no, I do not believe in god.

Dear Phil from Norfolk

I wasn't aware that The swan was a clearly designated (illegal) 'smoking pub' - I thought they were banned by law. Places or worship usually say what they are so you can choose whether to go in. Anyone could have walked in The Swan for a drink unaware that it was the only pub in Britain where you smoking was 'allowed'. Fair enough if the law allowed it to be but it blatantly doesnt. You can smoke in your own home because it's your private domain. A public house is just that - PUBLIC! And hey, smoking is banned within enclosed public places. If Hogan wants people to smoke, he should invite them round to his own house.
