Multiple people from Bolton have avoided being banned from the roads as the courts have declined to impose totting up disqualifications.

Under normal conditions a driver who accumulates 12 points on their licence will be given a ban from driving.

There are other offences such as drink driving or driving under the influence of drugs which entail an automatic ban.

However if a court deems that undue hardship will result from an individual not being to drive they can be allowed to keep their driving licences.

In the last two months three people from Bolton have benefitted from this rule.

Adam Sayers appeared in Wigan and Leigh Magistrates Court in January this year.

The 42-year-old admitted driving at 40mph on Chester Road, Stretford, which has a 30mph limit.

Sayers, of Martin Avenue, Little Lever, carried out the offence in March last ear while he was driving a Mercedes.

However he avoided a totting up disqualification as three employees relied on him to drive them to work.

The court rules as if he did not drive them to work they would all lose their jobs.

Sayers was fined £327 and given three points on his licence.

Gary Gartner appeared at Preston Magistrates Court in December.

While there, the 54-year-old admitted he drove in excess of the 30mph speed limit on Belmont Road.

He carried out the offence in October last year while driving a Volkswagen.

Garner, of Hough Lane, Bromley Cross, was spared a ban from the roads because it would result in loss of employment for Donna’s Dream House and a golf club.

The court also ruled this would lead to exceptional hardship to the Garner’s wife and done.

He was fined £150 and given three points on his licence.

Mohammed Hashemi appeared at Wigan and Leigh Magistrates Court in January.

He admitted he had failed to give the police the identify of the driver of a BMW alleged to have been guilty of an offence in March last year.

The 54-year-old avoided a disqualification as he transports children around and is responsible for his mother.

Hashemi, of Oakley Park, Bolton, was fined £1,000 and given six points on his licence.
