A BANNED driver thought he could evade arrest by giving his brother's name -- but was arrested anyway because his brother had also been disqualified from driving.

Mark Patterson had been banned from driving at Bolton Crown Court in 1999 and was caught behind the wheel on July 28 this year.

When stopped he gave his brother's name, not knowing he too was banned.

He persisted in the deception and was bailed in brother's name but failed to turn up for a court hearing.

Yesterday Patterson, aged 27, of Spa Road, Bolton, appeared at Bolton Crown Court for sentence for driving while disqualified, having no insurance and perverting the course of public justice.

The court was told Patterson gave his brother's name after he was stopped in Bury New Road, Bolton.

A warrant was later issued in his brother's name but the deception was uncovered when Patterson's fingerprints were matched.

He was arrested on September 5 when he admitted giving false details and was remanded in custody for a pre-sentence report.

The court was told that he had spent four weeks in custody and had broken his drug habit while on remand.

Judge Bruce Macmillan said it was Patterson's second disqualified driving offence and jailed him for five months and banned him from driving for 12 months.
