DON Faulkner referred to Holland Nurseries in Darwen Road as a garden centre (Letters, October 29).

I quote “I am the owner of the garden centre” and “we at the garden centre”. The plain fact is that no planning permission has ever been granted for such a business.

Controversially, on the remainder of Birtenshaw farmland, in the face of strong opposition by residents, Civic Trust etc, temporary glass houses were allowed, but for use as a nursery only. The decision notice (a legal document) was entailed by a condition note thus “for the avoidance of doubt, this consent does not allow for this site to be used as a garden centre”.

This was re-iterated in the planning meeting report of September 20, 2007, and I quote “Ref 11: The site shown as a nursery on the approved plan shall only be used as a nursery”. For the avoidance of doubt, the use of the site as a garden centre or other A1 retail use is not permitted”. “Reason — to protect the character of the green belt”.

If the present owner was not prepared to honour the covenant, he had the option not to buy. In the event he accepted this restrictive document which came with the deeds. He has since escalated the nursery limitations to achieve the status of a garden centre, and now wants retrospective planning applications.

I urge all those who believe in law, order, and justice, to send letters of objection to the town hall no later than December 8, 2009.
