A BOLTON man's High Court battle to stop a £12 million revamp of Raikes Lane Incinerator will be decided today. Roger Kirkman, who lives in Sidford Close, Darcy Lever - less than a mile from the incinerator - has challenged planning permission for the 'energy from waste' plant granted by Bolton Council in May.

The old Raikes Lane refuse burner was closed because it could no longer meet EU emissions standards.

In May, Bolton Council granted Greater Manchester Waste Ltd permission to carry out a refurbishment scheme at Raikes Lane to provide heating and electricity to Bolton homes from burning rubbish.

Lawyers for Mr Kirkman argued that planning permission was granted before a proper assessment of whether the incinerator was the best waste disposal scheme available.

They raised concerns over potential levels of dioxins and said emissions of nitrogen dioxide may be exceeded, coupled to those already emitted from the new hospital incinerator one mile away.
